猪场水帘:齐鲁证券前员工被起诉 曾透露公司让其“背黑锅”-新华

????新京报记者3月30日获悉，去年被批捕的齐鲁证券前员工彭晨日前已被莱芜市钢城区人民检察院正式起诉，起诉的原因是涉嫌非法吸收公众存款。据彭晨代理律师袁军透露，彭晨此次是以个人犯罪被起诉的，起诉并未涉及齐鲁证券，对此彭晨一方表示不认可。

????批捕一年后遭起诉

????因涉嫌非法吸收公众存款被批准逮捕将近一年后，齐鲁证券前员工彭晨日前被莱芜市钢城区人民检察院正式起诉。

????彭晨的代理律师北京中兆律师事务所律师袁军昨日向新京报证实，他已经于3月20日拿到了起诉书。根据起诉书，检察院起诉罪名是涉嫌非法吸收公众存款，值得关注的是彭晨此次是以个人罪名被起诉的，起诉并未涉及老东家齐鲁证券。

????“起诉书说彭晨个人吸收公众存款，对于以个人犯罪起诉这点我们是不认可的，公安和检查机关进行了这么长时间的调查，收集了那么多的证据，最后却以个人犯罪起诉，我们不认可，我们认为彭晨是职务行为。”袁军说。

????2014年4月25日，彭晨因涉嫌非法吸收公众存款被警方带走，此后被山东银山公安局拘留；2014年6月1日，彭晨被警方批准逮捕。

?????曾透露齐鲁证券让其“背黑锅”

????42岁的彭晨曾是齐鲁证券的员工，2012年加入齐鲁证券零售业务部，任该部门的副总经理，主要负责财富管理部的创新业务。2014年年初彭晨向齐鲁证券提交了辞职书。

????据记者获悉，彭晨被带走源于其任职期间牵头发起的私募产品，即有节1号和有节2号，有节1号总产品规模为7877万元，齐鲁证券客户募集规模2000万元；有节2号总产品规模为7739万元，齐鲁证券客户募集规模2698万元。两款产品于2014年4月24日到期后出现无法兑付的麻烦。在这种情况下，山东莱芜的一位客户向公安机关举报了彭晨。

????彭晨在被带走前向媒体透露，上述案子是齐鲁证券的公司行为，自己只是产品负责人之一，齐鲁证券有意让其“背黑锅”。

????齐鲁证券则称该案为彭晨个人行为。齐鲁证券总裁毕玉国在彭晨被带走之后曾公开表示，齐鲁证券本身没有涉及“私募理财产品合作模式”相关产品对外推广、销售的情况。
